Guidelines to Applicants for the Registration of Marks

 
1.       Any application to register a mark (trade/service/collective) shall be made on the prescribed form available at the Industrial Property Office or may be downloaded from our website (http://foreign.gov.mu)
 
2.       Prior to filing an application, applicants are advised to carry out a search to ascertain whether the proposed mark does not conflict with any registered mark or pending application.
 
3.       A clear reproduction of the mark shall be affixed in the space provided for under the heading ‘Representation of the mark’ in the application form and three additional reproductions of the mark shall be attached (4 identical reproductions in all). 
 
4.       Any figurative element shall be clearly identified and the correct title of the mark shall be inserted.
 
5.       A declaration claiming priority shall be made at the time of filing the application for registration and the applicant shall clearly indicate:
(a)      the date and number of the earlier application,
(b)      the State in which the earlier application was filed,
(c)      if the earlier application is a Regional or an International application, the Office with which it was filed and the State or States for which it was filed and submit a certified copy of the earlier application within a period of 3 months of the date of the application.
 
6.       The goods and services for which the registration of the mark is requested shall be clearly and correctly listed under the applicable class or classes of the Nice Classification for the International Registration of Goods and Services. 
 
7.       The application has to be accompanied by the prescribed fees which are computed as follows: For any two classes: Rs 3150, each additional class: Rs 1575.
 
8.       The attention of applicants is drawn to Section 49 of the Act which provides that where an applicant’s ordinary residence or principal place of business is outside Mauritius, he shall be represented by a legal practitioner residing and practicing in Mauritius or an approved agent.
 
9.       An application consisting of a foreign word shall be accompanied by a transliteration and/or translation of such word, stating the language to which it belongs.
 
10.     A Power of Attorney appointing an approved agent or legal practitioner shall be registered with the Registrar General and shall be filed together with the application or within two months from its filing date.
 
11.     The signature of the applicant/s and the date of the application shall be inserted in the appropriate space provided in the form.

Guidelines to Applicants for the Renewal of the Registration of a Mark

 

Renewal of Registration of a mark

 
1.       Any application to renew the registration of a mark shall be made on the prescribed form available at the Industrial Property Office or may be downloaded from our website (http://foreign.gov.mu)
 
2.       The request may be filed within 6 months prior to the expiration of a registration.
 
3.       The application has to be accompanied by the prescribed fee:
 
           For one class:                                 Rs 3,150
            Each additional class:                    Rs 1,575
           
 
4.      Applicants are required to insert correct information regarding:
 
v  the registration number and date;
 
v  the list of goods and their corresponding class/es for which renewal is being applied;
 
v  the full name and postal address of the applicant (be it the registrant or the agent) so as to enable proper despatch of Renewal Certificates.
 
4.       Please note that you are not allowed to renew the mark for class/es and goods that are not on the registration certificate.
 

Late Renewal

 
5.       A further period of 3 months, as from the date of expiry of the registration of a mark, may be allowed for the renewal of the registration subject to the payment of a surcharge fee of Rs 1050.
 
6.       Where a registered owner fails to pay the renewal fee and the surcharge fee, where applicable, the registration of the mark shall not be renewed and the mark shall be removed from the Register as from the last expiry date of the registration of the mark.
